Builder inventory versus a recent resale

The two kinds of listing on this page behave differently at the offer table. Builder inventory is a house the builder still owns, sold on the builder's own purchase agreement: the price usually includes HST with the rebate assigned to the builder, the closing date can move, Tarion enrolment starts at your closing, and items such as sod, the driveway top coat and the fence may be outstanding, along with development charges that some agreements pass to the buyer. Have a lawyer read every schedule. A resale of a recent build is a normal Ontario purchase on the standard form: the remaining Tarion coverage transfers to you, HST does not generally apply because the home was lived in, and you can see how the house has settled, where the drywall has cracked and whether the basement stayed dry through two springs. In either case check the grading certificate, any road fee on a rear-lane lot and whether the neighbouring lots are still under construction.

Does the Tarion warranty transfer when I buy a resale of a new home in Oshawa?

Yes. Tarion coverage attaches to the home from its first closing and passes to later owners for the balance of the term: one year for workmanship and materials, two for the building envelope and major systems, seven for major structural defects. Ask for the enrolment number, check the remaining dates with Tarion and review any claims already filed.

Do I pay HST when buying a new construction home in Oshawa?

On a home bought from the builder, HST applies and the advertised price usually includes it with the new-housing rebate assigned back to the builder, provided you will live in the home as your principal residence; investors may have to pay the rebate up front and claim it later. On a resale of a recently built home that was occupied, HST does not normally apply. Confirm your situation with a lawyer or accountant.
